Terms of Service

Version 1.0 — Effective date: April 2026

1. Acceptance of Terms

By registering for or using the POS System platform ("the Service"), operated by Ibn Zelt (SSM: 201403253913 / IP0418148-M) ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a business, you represent that you have authority to bind that entity. If you do not agree to these Terms, do not use the Service.

2. Service Description

POS System provides a cloud-based, multi-tenant point-of-sale SaaS platform designed for Malaysian businesses. The Service includes inventory management, transaction processing, receipt generation, LHDN e-invoice submission, and reporting tools. Features and pricing tiers are described on our website and may change with notice.

3. Merchant Obligations

As a merchant using the Service, you agree to:

  • Provide accurate, current, and complete information when registering and throughout your use of the Service.
  • Only sell products and services that are lawful under Malaysian law and applicable regulations.
  • Comply with all applicable Malaysian laws, including the Sales and Service Tax Act 2018, the Consumer Protection Act 1999, and LHDN e-invoicing requirements where applicable.
  • Maintain the security of your account credentials and promptly notify us of any unauthorised access.
  • Not use the Service to process transactions for illegal goods, money laundering, or any prohibited purpose.
  • Ensure that your customers are informed of any personal data collected through the storefront, in compliance with PDPA 2010.

4. Payment Terms

Access to the Service is provided on a subscription basis. By subscribing, you authorise us to charge your payment method on a recurring basis at the start of each billing period.

  • Billing cycle: Monthly or annual, as selected at signup.
  • Auto-renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
  • Partial months: There are no refunds or credits for partial months of service. See our Refund Policy for the 14-day new subscriber guarantee.
  • Price changes: We will give at least 30 days' written notice before increasing subscription prices.
  • Failed payments: If a payment fails, access to the Service may be suspended after a 7-day grace period.

5. Prohibited Uses

You must not use the Service to:

  • Process transactions for illegal goods or services, including but not limited to unlicensed pharmaceuticals, counterfeit goods, or prohibited substances.
  • Engage in fraudulent activity, including processing fictitious transactions or chargebacks abuse.
  • Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
  • Reverse-engineer, decompile, or create derivative works from the platform software.
  • Use the Service in a manner that disrupts, damages, or impairs the Service for other users.
  • Transmit malware, viruses, or other malicious code through the Service.

6. Intellectual Property

Your data: You retain full ownership of all data you input into the Service, including product catalogues, customer records, and transaction history ("Tenant Data"). We claim no ownership over Tenant Data and process it only as instructed to provide the Service.

Platform IP: The Service software, design, trademarks, and all related intellectual property belong to Ibn Zelt. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during your subscription. This licence does not include any right to reproduce, distribute, or modify the platform.

7. Limitation of Liability

To the maximum extent permitted by Malaysian law, Ibn Zelt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 3 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Malaysian law.

8. Termination

By you: You may cancel your subscription at any time through the account dashboard. Cancellation takes effect at the end of the current billing period.

By us: We may suspend or terminate your account with 30 days' written notice. We may terminate immediately for material breach of these Terms (including prohibited uses), non-payment, or if required by law.

Data export: Following termination, you will have 30 days to export your Tenant Data before it is scheduled for deletion. We will make a data export tool available for this purpose. Mandatory retention periods under Malaysian tax law still apply.

9. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements. We are not responsible for the accuracy of e-invoice submissions if the underlying transaction data you provide is incorrect.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Malaysia.

11. Changes to These Terms

We may update these Terms from time to time. We will notify registered account holders via email at least 14 days before material changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
